1. Eligibility and Minors

- If you are under the age of majority in your country, you may use the App only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the App.
- By using the App, you confirm that the information you provide is accurate and that you have the right and consent to use the App.
2. Your Account
- You must register with a valid email address and a password to use most features.
- You are responsible for keeping your login details secure and for all activity under your account.
- You must verify your account (for example, via a one-time password sent to your email) where required.

3. The Service

We may add, change, suspend, or remove features at any time. We aim to keep the App available but do not guarantee uninterrupted or error-free service.
4. Educational Content Disclaimer
- Exam papers, questions, model answers, marking guides, hints, and scores are provided for study and practice purposes only.
- Examia content is not official examination material and is not affiliated with, endorsed by, or guaranteed to match any official examination board or institution.
- We do not guarantee that practice on the App will result in any particular grade, exam result, or outcome.
- Automated and AI-assisted scoring may contain errors; use it as a study aid, not a definitive assessment.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in breach of these Terms.
- Cheat, manipulate, or artificially inflate XP, scores, rankings, or clan standings.
- Attempt to access accounts, data, or systems you are not authorised to access.
- Reverse-engineer, copy, scrape, or redistribute the App or its content except as allowed by law.
- Upload unlawful, offensive, infringing, or harmful content, including as a profile picture.
- Interfere with, overload, or disrupt the App, its servers, or its security.
- Use bots, automation, or exploits to gain an unfair advantage.
We may suspend or terminate accounts that breach these rules.
6. User Content
- You may submit content such as a profile name, avatar, and exam answers ("User Content").
- You retain ownership of your User Content, but you grant us a licence to store, process, and display it as needed to operate the App (for example, showing your name and avatar on leaderboards).
- You are responsible for your User Content and confirm you have the right to submit it.
- We may remove User Content that violates these Terms.
7. Intellectual Property
The App, its design, software, branding, and content (other than your User Content) are owned by Examia or its licensors and are protected by intellectual property laws. You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to use the App for your own study. You may not use our name, logo, or content without permission.
8. Gamification, Clans, and Leaderboards
- XP, levels, tiers, rankings, clan membership, and rewards are virtual and have no monetary value, cannot be exchanged for cash, and may be adjusted, reset, or removed at our discretion.
- We may recalculate or correct rankings and XP to maintain fairness or fix errors.
9. Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we collect and handle your information. By using the App, you agree to that Policy.
10. Suspension and Termination
- You may stop using the App and delete your account at any time.
- We may suspend or terminate your access if you breach these Terms, misuse the App, or where required by law.
- On termination, your right to use the App ends. Provisions that by their nature should survive (such as intellectual property, disclaimers, and liability limits) will continue to apply.
11. Disclaimers

12. Limitation of Liability
To the fullest extent permitted by law, Examia and its operator will not be liable for any indirect, incidental, special, or consequential loss, loss of data, loss of profits, or exam/academic outcomes arising from your use of, or inability to use, the App. Where liability cannot be excluded, it is limited to the maximum extent permitted by law.
13. Indemnity
You agree to indemnify and hold harmless Examia and its operator from claims, damages, and costs arising from your breach of these Terms or misuse of the App. For minors, this obligation rests with the responsible parent or legal guardian.
14. Changes to These Terms
We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, notify you in the App or by email. Continued use of the App after changes means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of Zimbabwe. Any disputes will be subject to the jurisdiction of the courts of Zimbabwe.
